Fire Safety Risk Assessment

The Regulatory Reform (Fire Safety) Order 2005 requires that the ‘responsible person’ in a premises must take reasonable steps to reduce the risk from fire and make sure people can safely escape if there is a fire.

Under the order, anyone who has control of premises or anyone who has a degree of control over certain areas or systems may be a ‘responsible person’. For example, it could be:

  • the employer for those parts of premises staff may go to;
  • the managing agent or owner for shared parts of premises or shared fire safety equipment such as fire-warning systems or sprinklers;
  • the occupier, such as self-employed people or voluntary organisations if they have any control; or
  • any other person who has some control over a part of the premises.

The main rules under the Order include that you must:

  • carry out a fire-risk assessment identifying any possible dangers and risks;
  • consider who may be especially at risk;
  • get rid of or reduce the risk from fire as far as is reasonably possible and provide general fire precautions to deal with any possible risk left;
  • take other measures to make sure there is protection if flammable or explosive materials are used or stored;
  • create a plan to deal with any emergency and, in most cases, keep a record of your findings; and
  • review your findings when necessary.

Very similar duties exist in Scotland under the Fire (Scotland) Act 2005 and The Fire Safety (Scotland) Regulations 2006.

Northern Ireland is still awaiting a date to implement the fire safety legislation article of the Fire And Rescue Services (Northern Ireland) Order 2006 and is still operating under the Fire Services (NI) Order 1984 and the Fire Precautions (Workplace) Regulations (NI) 2001

A Fire Risk Assessment would be carried out within all areas of the building for which you are responsible and a report prepared, in accordance with the Fire Safety Order 2005 or Fire (Scotland) Act 2005 as appropriate *. The report would contain an Action Plan summarizing the steps necessary to reduce any unacceptable risks and giving an indication of the time scale within which such work could reasonably be expected to be carried out.

Unlike a health and safety risk assessment, which would look at common areas only, the fire risk assessment would consider tenanted areas also. This is because if there is more than one responsible person in any type of premises (e.g. a multi-occupied complex), all tenants must take reasonable steps to co-operate and co-ordinate with each other.

* In Northern Ireland the report will reflect the current legislative situation and will also include a Fire Certificate Compliance Audit, as fire certificates are still live documents in this area.
